He clearly was spying for Israel at the behest of their government. Make him do the time and finish his sentence. The article on Wikipedia says he'll be sent back to Israel after he finishes his sentence.

Certainly several other presidents could have pardoned him. He's been in prison since 1987, so we've had four presidents prior to Obama who could have pardoned him and chose not to (Reagan, Bush I, Clinton, Bush II).
