12. "States rights"

This puts the red state governors in a really interesting position. They are always talking about "states rights". In this case, they really wan the right for the state to do nothing, while its citizens suffer. That is the "state's right" they are talking about. And the law cuts that off by saying, fine, if you can't do it, then the Federal govt will do it. That probably helps the law stand up in the SCOTUS.

It seems silly to develop 50 different systems to do what amounts to the same damn thing. It is essentially a version of Craigslist that just lists policies. There is some administration to make sure that the policies meet the ACA standards, and if the states don't want to do that, fine. It is the same set of standards nationally anyway, so it isn't like Aetna will offer a completely different program in Iowa than they offer in Nebraska.

There are already several private directories such as http://www.healthinsurancefinders.com/. The Federal government could contract with one of these to set up the registry nationally.
