COLUMBUS A federal judge granted the Obama campaigns request to restore in-person early voting on the Saturday, Sunday and Monday before the Nov. 6 election in Ohio, delivering a victory to Democrats in their fight with Republicans over voting access.
Republican Ohio Attorney General Mike DeWine immediately said he will appeal.
U.S. District Court Judge Peter C. Economus on Friday ruled two recent Ohio laws unconstitutional because they eliminated those three voting days for everyone except military personnel and overseas Ohioans. Economus wrote that all Ohioans have a constitutionally protected right to participate in elections on an equal basis.
Plaintiffs will suffer irreparable injury if in-person early voting is not restored the last three days before Election Day, and there is no definitive evidence before the Court that elections boards will be tremendously burdened, Economus wrote. Certainly, the public interest is served by restoring in-person early voting to all Ohio voters.
