The authority that CBP has at checkpoints are different than the authority they have to pull you over. If they pull you over, they must have reasonable suspicion just like any other cop. At checkpoints they have the authority to brieflydetain you to ask questions, but that's it. They do not have the authority to hold you for hours even if you don't answer their questions. You don't give up your fourth amendment rights just because you're near the border.
