3. 10yrs to Death, depending


First, the CAT makes no distinction between the "guilt" or "innocence" of the victim.

The TX cop that waterboarded an inmate was sentenced to 10yrs in prison.

The War Crimes Act of 1996 (http://en.wikipedia.org/wiki/War_Crimes_Act_of_1996) makes no distinction between conspiring to commit torture (giving orders to but not actually doing it) and the actual act. Penalties IIRC are up to Life in prison unless victim is killed, in which case the Death Penalty can be sought.
