are utter BS... the OP's blurb indicates the tribunal found this to be an issue of training (and consent).

I am very, very, very much in favor of lack-of-competence/training/familiarity exemptions. People should not be doing things they are not competent to do because of otherwise-legitimate social and legal pressure not to discriminate against protected classes.
