Retired servicememebrs are still subject to the UCMJ as long as they are receiving retirement pay.

He can therefore still be Court Martialed for his offenses under the UCMJ. And and plea deal made by Mueller doesnt have to be followed by military authorities.

All it takes is a new Commander in Chief to order the Pentagon to go after him.
