I think it's also quite likely that Kushner is flat out ignorant of the forms and protocols of government. He's not alone in this administration for that shortcoming. None of them seem to know what procedures to follow, they don't ask anyone that might know, and they just seem to think that they'll be okay in the end. But this isn't like the world of big developers and high finance, this is the federal government, and this stuff matters. Unlike development deals, there isn't another deal to be made on another building on the next street over. There's only one government, and there are rules to be followed.

I think Kushner is devious enough that he thought to do this and smart enough to keep it as secret as he could, but ignorant enough not to know how serious a breach this is.
