One could easily interpret that dog as sleeping/resting. I probably wouldn't smash a window unless I had observed the dog confined for a long period of time in the heat. Then I might do it. But if I just stumbled upon a vehicle, I probably wouldn't feel that I had enough info to justify breaking in.
