Our technology age has come so fast that the legal system just can't keep up with it to provide protections for consumers. There are some Think Tanks and Legal Scholars working on it...and EFF has addressed this. Our Govt. can't keep up with it...but, the Private Outsourcing companies (our Govt. is using to "save money" are having a grand old time exploiting the legal holes in Data Collection on private citizens.
