I bet this Decorated vet thinks, at least his attorney asserts, that his being av et has more rights than other Americans and his right to make terroristic threats trumps the legislator's right not to have her family's well being threatened.

If the prosecutors wanted to play tough, the charges should be terroristic threats and stalking.
