(4,036 posts)That if a judgement is made prior to trial then Smith can file charges again; whereas if the trial starts and she then finds Trump innocent then Trump is free and Smith can do nothing; So speculation is that she is laying all of these conditions to give her room so that when the trial starts she can attribute his innocence to something already mentioned but no judgement rendered.
Smith is probably waiting for her next big mistake so that he can ask to have her removed.
But the smart money says - she will find Trump innocent if he goes to trial before the jury even has a chance to render a verdict. Oh, once a jury is empaneled then double jeopardy is at play. But I am not a legal person
I read that when she was being considered for the appointment to the bench she had to submit some documentation on her qualifications and she submitted a recipe/cookbook. Whether true or not, I dont know but I no longer doubt it.
