note I am not saying it is for sure unconstitutional just that it is reasonably argued that it is. Which, given our current court, is very problematic. For the same reason we had to have an amendment that permitted income taxes, it is possible we need one for wealth taxes. I did see a very good idea though on Slate magazine. Pass a law with the wealth tax and an alternative tax (very high marginal rate) that would take effect is the wealth tax is struck down. The high marginal rates are clearly constitutional as is passing a law that has an plan B.
