But cannot on her own, decide the appeal. When you appeal to the SC, the entire court hears it, and if a majority decides the appeal has merit, the court will take the case. Keep in mind, HUNDREDS of cases a year get sent up, and maybe 2 dozen merit the legal attention of the Court and actually get a full hearing.
Usually, the appeals court decision is allowed to stand. Stuff like this is settled Law, and I'm betting they dont even take it, on the argument that maybe the president is immune, but his tax firm from BEFORE his swearing in, damn sure doesnt have immunity from investigation or prosecution...especially since said firm is trying to comply with the lower courts order, and its TRUMP that wants this blocked.

My 2 cents is that Roberts is going to kick mr. pResident square in the balls, and then go do something more interesting with his workday.
