TITLE IX Policy Changes - article from ASU -

http://www.statepress.com/article/2018/09/sppolitics-department-of-education-proposes-controversial-new-campus-sexual-misconduct-policies

Jasmine Lester, the founding director of Sun Devils Against Sexual Assault, a non-profit organization for survivors based out of ASU, said she sees several potential issues with the proposed changes. Her organization battles sexual misconduct that has occurred among ASU students as well as faculty.
Lester said she found one of the proposed policies particularly troubling.

Devos at your service....

“One of the guidelines says that colleges will have to launch any investigation into sexual violence with the assumption of innocent before guilty for the accused,” Lester said. “In a perfect world, that’s great, but this isn’t a perfect world. We live in a rape culture where rapists don’t go to jail, and cases don’t move forward. All that guideline means is that investigators have to enter a sexual assault case already assuming that the victim is lying.”

“I can’t imagine anyone is going to let someone accused of sexual assault actually cross examine the accuser, obviously that’s not acceptable,” Garrett said. “But cross examination is an invaluable tool in determining credibility, and it’s important because when you’re questioning someone in real time and watching their expressions, their responses are going to be more honest."

Someone ruined a football game last night

I have NEVER been so agitated - when Monday Night Football comes on - I am usually in the kitchen, starting dinner, my back is to the TV..so I listen - low and behold, I could not listen...a most grating voice I have ever heard.

STOP ESPN..you make me think you have a salary cap when it comes to your announcers...this person does not know football - this person tries to talk tough, and even fails at that - like I said to my hubby, if I was a blind person I wouldn't know what the hell was going on....and that voice..I had to mute the rest of the game...

Off to write my note to ESPN......MNF is on the line as it stands right now...

Paul Manafort Evidence of Collusion? - at Just Security - A fine

list of FACTS connecting Manafort - T rump - Rushkies - updates included from 6/16/2018

I will keep this simple. Here are the facts about Paul Manafort, whose history with President Donald Trump dates back decades and who served as chairman of the Trump Campaign and remained something of an informal adviser after resigning.

The following facts essentially speak for themselves. Simply put, any fair reading of the public record would surely come to the conclusion that there is significant evidence of collusion–or, to put it more precisely, evidence of a conspiracy with Russians and violations of federal campaign finance law.

The first sample of fact....

1. Manafort proposes to Putin-linked, Russian oligarch a plan to “greatly benefit Putin,” and they get to work (2005-)

In the end, let's hope Mueller can prove collusion...as the article mentions...

there is significant evidence of collusion already in the public record

It is a figure of speech - "Toast" - a metaphor..no one is suggesting he should be

disbarred...considering the time, effort, and considerable amount of money it takes to actually get to the bar exam..if I were his mother or father I would wash his mouth out with soap...

Me thinks he has shot himself in the foot , metaphorically speaking, of course...what FIRM would hire him now..let alone a client walking into his store - Trump, maybe or his ilk...

oh, that's right, the building where he rents an office - they want nothing to do with him...just one question to this miscreant, "have you no decency"

I often ask, is it nature, or nurture....

The young fellow in the video demonstrated more civility than this jerk..

Be well, Jim Lane, congrats on passing the bar..and not evah having a complaint registered against you..

That Russia-Trump Thing..Shugerblog, Masterful Timeline w/links

Russia’s sale of Rosneft Gas is the key event in the Steele Dossier’s quid pro quo allegation. On June 2016, Russians allegedly offer Trump associates a massive payout derived from the commissions on Russia’s sale of 19.5% of state energy giant Rosneft ($11 billion), in return for lifting sanctions.

Weeks after the election, Flynn and Kushner are in contact with Russian officials. Then Russia sells a 19.5% stake in Rosneft in a concealed deal, eventually revealed to be with Qatar. Immediately after the deal, a Qatari diplomat allegedly met with Cohen and Flynn at Trump Tower.

Jed Shugerman - at shugerblog.com - was on with Rachel tonight..and just blew me away with his investigative reporting on this Russia/trump thingy..he also writes for Slate...Professor at Fordham and a true American Patriot..if you have any questions about this subject, I implore you to read his blog..

What is an OLC opinion vs a Judiciary Opinion

Chris should have had this RWNJ debate others who understand that the OLC opinion is

an Executive opinion..NOT a judiciary opinion....I bet the RWNJ would not have appeared if that was the format...like invite Bob Bauer WH counsel for our President Obama..here is just a how he sizes up the Nixon Long Shadow and the judiciary...

a special counsel should not consider himself bound by an opinion of executive branch lawyers that turns on its head, and to the executive’s advantage, what the courts have made plain about their role in adjudicating the scope of presidential immunities from legal process. The special counsel is charged under the regulations with investigating and prosecuting federal crimes. If the special counsel has cause to believe that the president committed such, he should pursue the testimony that he needs and bring charges if the evidence supports them.

https://www.justsecurity.org/55655/nixons-long-shadow-donald-trumps-emerging-constitutional-defense-investigation-and-indictment/

I had to read the legal analysis several times to understand what Bob Bauer was getting at...thus the excerpt - have at it...

Be well all, we will get through this...

This is the conclusion of the article

The president has the option, of course, of invoking his Fifth Amendment rights.

Or, as appears increasingly possible, Mr. Trump and his lawyers can turn for inspiration to the Nixon presidency and the Watergate era and make his case for the president’s immunity from criminal investigation and prosecution. There is little reason to believe that the results will be any different 44 years later.
