Terrible Arguments Against the Constitutionality of the Mueller Investigation

In an early-morning tweet last week, President Trump took aim once again at Special Counsel Robert Mueller, but with a brand new argument: “The appointment of the Special Councel,” the president typed, “is totally UNCONSTITUTIONAL!”

He (Trump) didn’t explain what his argument was, or where he got it, but a good guess is that it came from some recent writings by a well-respected conservative legal scholar and co-founder of the Federalist Society, professor Steven Calabresi. Unfortunately for the president, these writings are no more correct than the spelling in his original tweet. And in light of the president’s apparent embrace of Calabresi’s conclusions, it is well worth taking a close look at Calabresi’s argument in support of those conclusions.

Calabresi has made his argument in a Wall Street Journal op-ed, on a Federalist Society teleconference and in a more detailed paper he styles as a “Legal Opinion.” He contends that all of Special Counsel Mueller’s work is unconstitutionally “null and void” because, in Calabresi’s view, Mueller’s appointment violates the Appointments Clause of the Constitution, Article II, Section 2, Clause 2.

HOWEVER:

In short, there is no serious argument that Special Counsel Mueller’s appointment violates the Appointments Clause specifically or the separation of powers generally.

Former Albany-Area Judge Pleads Guilty to Scamming Millions From Estate

A former Capital Region town justice and lawyer pleaded guilty on Monday to working with a financial adviser to bilk about $11.8 million from trust funds that they were responsible for overseeing.

Former Town of Guilderland Justice Richard Sherwood agreed to resign from the bench in April, pleaded guilty to federal money laundering and tax crime charges and a state charge second-degree grand larceny, a class C felony, according to news releases from the New York Attorney General’s Office and the U.S. Attorney’s Office for the Northern District of New York.

He faces between three and 10 years in prison on the state charge and up to 20 years in prison on the federal charges, the releases stated.

Washington Post hits Trump for 'alienating allies while fawning over dictators'

The Washington Post's editorial board on Monday knocked President Trump feud with Canadian Prime Minister Justin Trudeau following the Group of Seven (G-7) summit.

The editorial board criticized Trump trade adviser Peter Navarro's comment Sunday that there is a "special place in hell" for Trudeau, a remark he made after the summit ended.

Trudeau said at a news conference after Trump left the summit Saturday that Trump's decision to impose tariffs on Canadian steel and aluminum on the basis of national security was "kind of insulting."

The remarks angered Trump, prompting him to tear into Trudeau as "weak" and "dishonest" in a tweet, while his aides harshly criticized the Canadian leader during appearances on the Sunday morning talk shows.

Just hours before his historic summit with North Korea's leader, President Trump on Monday ripped the "haters & losers" who have expressed skepticism about its success.

"The fact that I am having a meeting is a major loss for the U.S., say the haters & losers. We have our hostages, testing, research and all missle (sic) launches have stoped (siic), and these pundits, who have called me wrong from the beginning, have nothing else they can say! We will be fine!" Trump tweeted.

A few weeks ago most of Wall Street was predicting Goldman Sachs stock price would reach $285. Some actually touted $300 per share or more; with a low of $245. Currently the stock hovers at $233.

But Sachs has serious legal woes, are mounting, globally.

Kris Kobach used taxpayer money to pay $1000 fine in federal case

Kansas Secretary of State Kris Kobach used a state-issued credit card to pay a $1,000 fine for misleading a court about documents related to a 2016 meeting with Donald Trump.

The Topeka Capital-Journal reported Friday that an open records request revealed that the payment was made last year using a state-issued credit card belonging to Craig McCullah, who was serving as deputy assistant secretary of state at the time.

McCullah, who is now seeking the Republican nomination for secretary of state, told the Capital-Journal in an interview that he was not aware that his card had been used to make the payment. He said he was deployed in Ukraine with the Oklahoma Army National Guard at the time of the payment.

"I was out of the country," he said. "I was never told about this."

If Bain Capital benefited from fraud = then Mitt benefited from fraud.

Jury finds former CIA officer guilty of espionage

A former CIA agent was convicted by a jury in Virginia on Friday of giving classified secrets to a Chinese intelligence agent.

Kevin Mallory was found guilty of conspiracy to deliver information, attempted delivery, delivery of defense information to aid a foreign government and making materially false statements.

Mallory traveled to China in March and April of 2017, where he met a man he suspected to be a Chinese intelligence operative, the Justice Department said in a release.

The Washington Post reported that Mallory attempted to convince CIA agents that he was a "triple agent" working to expose the Chinese operation.

Former Trump appointee resigns from Trump-aligned group after racist comments

A former Trump administration appointee resigned from his position at the Trump-aligned America First Policies this week, after companies said they wouldn't contribute to the group because of his past racist comments, according to CNN.

In January, Carl Higbie resigned as chief of external affairs for the Corporation for National and Community Service, which runs AmeriCorps, after racist, sexist and anti-Muslim comments from his past came to light.

Despite the revelations, he joined the nonprofit America First Polices in March as its director of advocacy. The group has reportedly raised $26 million to support President Trump's agenda.

But Higbie and other staffers' past remarks led three corporate donors - CVS Health, Southern Company and Dow Chemical - to announce earlier this week that they would no longer donate to the group.

Donald the Great (in his own mind) is running out of time

In this past week there's been a major shake-up in the Trump Administration's circle of the wagons.

Everybody is starting to abandon-chit!

Not a typo there, folks. From Paul Ryan, to Mitch McConnell, Trump's haughty ways is causing the key party members to begin to distance themselves.

All of which has become more readily-apparent after Trump expounded that he could pardon himself (which he cannot do); and the dark clouds now looming even worse with the new indictments of Manafort & friend.
