Washingon Post: The indictment argues that Trump knew the 'big lie' was a lie

Trump “repeated his knowingly false claim” on Jan. 6 itself.


“The Defendant spread lies that there had been outcome-determinative fraud in the election and that he had actually won,” the indictment says. “These claims were false, and the Defendant knew that they were false.”

Smith cites examples — many previously known — of those around Trump directly informing him that his claims were false and his schemes dubious. They included Vice President Mike Pence, top Justice Department officials, top White House attorneys and campaign staff members, key state legislators and officials, and state and federal courts.

The indictment cites examples of Trump’s being informed that specific claims were false and then proceeding to lodge them anyway. Smith makes a point of isolating a single claim from each of five key states — Arizona, Georgia, Michigan, Nevada and Pennsylvania — each time punctuating the example by saying that Trump “repeated his knowingly false claim” on Jan. 6 itself.

The judge assigned to Trump's Jan. 6 case is a tough punisher of Capitol rioters

WASHINGTON -- The federal judge assigned to the election fraud case against former President Donald Trump has stood out as one of the toughest punishers of rioters who stormed the U.S. Capitol in an attack fueled by Trump's baseless claims of a stolen election. She has also ruled against him before.

U.S. District Judge Tanya Chutkan, a former assistant public defender who was nominated to the bench by President Barack Obama, will oversee the case accusing Trump of trying to overturn his 2020 election loss in the two months leading up to the violent assault on the U.S. Capitol by his supporters.

Chutkan has often has handed down prison sentences in Jan. 6, 2021, riot cases that are harsher than Justice Department prosecutors recommended.

She rejected his arguments that he could hold privilege over documents from his administration even after President Joe Biden had cleared the way for the National Archives to turn the papers over. She wrote that Trump could not claim his privilege “exists in perpetuity.”

Washington — Former New York City Police Commissioner Bernard Kerik has turned over thousands of pages of records to special counsel Jack Smith as part of the federal investigation into efforts to stop the transfer of presidential power after the 2020 election, sources familiar with the matter confirmed to CBS News.

The documents were submitted to Smith on Sunday. A source close to Kerik's legal team said they believe the records, which include sworn affidavits from people raising concerns about the integrity of the 2020 presidential contest, show there was a genuine effort to investigate claims of voter fraud in the last election.

Rudy Giuliani Admits False Statements About Georgia Election Workers

Former Donald Trump lawyer Rudy Giuliani has admitted to making false statements regarding election workers the former president claimed had tampered with ballots in the 2020 presidential election count in Georgia.

Giuliani did not contest that "to the extent that the statements were statements of fact and otherwise actionable, such actionable factual statements were false."

The statement by the Republican lawyer came as part of a defamation lawsuit brought by Ruby Freeman and Wandrea "Shaye" Moss, who alleged that they had faced harassment after Giuliani and Trump claimed they had counted extra votes.
