Texas Republicans' last-minute challenge to drive-thru voting in Harris County dismissed by appeals

Drive-thru and curbside voting programs in Harris County can continue after a state appeals court Wednesday quickly threw out a last-minute lawsuit filed by the Texas Republican Party challenging the county's efforts to provide more voting options during the coronavirus pandemic. The state GOP had filed suit Monday night asking the court to place limits on curbside voting and halt drive-thru voting.

The appellate judges said the party and a voter who filed the suit did so too late, and did not show how they specifically might be injured by the voting practices. The lawsuit was filed just hours before early voting polls opened and more than a month after the Harris County Clerk announced his plan for drive-thru voting.

"The election is currently in progress and the relators delayed filing this mandamus until over a month after learning of the actions of the Harris County Clerk’s Office," the panel of three judges on Texas' 14th Court of Appeals wrote in their ruling dismissing the case.

• Doug Emhoff will travel to Virginia where he will visit Charlottesville in the morning to launch a lit drop and voter registration drive with Fifth District candidate Dr. Cameron Webb and UVA Students for Biden. In the afternoon, Emhoff will attend a registration drive and yard sign pick up event in Loudoun County with Congresswoman Jennifer Wexton (VA-10), State Senator John Bell (Loudoun County), and other elected Virginia leaders. Later in the day, Emhoff will travel to Fairfax for a lit drop launch with Congressman Gerry Connolly (VA-11), Delegate Kathy Tran (Fairfax County), GMU Students for Biden, and Fairfax Democrats.

• Today, Biden for President will host a Military Service Celebration with Veterans and Military Families for Biden. Featuring Ray Mabus and Norman Lear, the celebration will recognize all military services on the 245th birthday of the U.S. Navy on October 13th, honoring our traditions and our commitment to service. Anthony Fauci, an expert on infectious diseases who has exhorted the nation for months to wear masks and maintain social distance, told CNN that although it's unlikely, Trump could face "a reversal – meaning going in the wrong direction and get into trouble."

A White House-themed online gift shop may be offering $100 "Trump Beat COVID" commemorative coins too soon. The danger window can easily stretch to 10 days, said Mangala Narasimhan, an intensive care physician in New Hyde Park, New York.
