I may be a simple urban retired Chief and Sea Lawyer, but I do know a few things...
1. 1st Amendment rights end when the felonies begin. Breaking windows doors, or other items, shitting on floors, and semi-permanent Vandalism (i.e., spray paint, etching, or permanent marker instead of sidewalk chalk) is not a 1st Amendment right for "free speech", "assembly for redress" or any of the other rights enumerated under them.
2. Threats and boasting of violence or violent activity is not protected. If you threaten to bust my nose because of my
Penzies bumpersticker, you are committing assault, even if you never took the swing (that's the battery). If you threaten to burn my house down unless I sign up to be part of your MLM scheme, that's threats and extortion, amongst other things.
If you are part of a mob shouting "Find Pence, Hang Pence" - you are committing a felony.
Now, silly MAGAt, if you were really just exercising your first amendment right, you would have remained outside with your signs and your Trump Cape, and stayed outside instead of following the crowd of thugs and looters. I'd even suggest you use your cell phone to take pictures and videos of the mob, or maybe just hightail it out of there once you started seeing evidence that this was no longer a protest or protest march, but a fucking riot where people and property are getting damaged.
Being part of a mob is not being a "peaceful protester". Being part of a mob is just as protected under the Constitution as being part of a pack of feral hogs.
