St. Louis homeowner who shot burglar is arrested for being a felon with gun

ST. LOUIS • Police have arrested a St. Louis homeowner who shot and critically injured a would-be burglar trying to kick in the back door of his home.

But the homeowner wasn’t arrested for shooting the burglar.

Instead, it’s because he was a felon on probation and not allowed to have a gun, said Schron Jackson, a spokeswoman for the St. Louis Police Department.

The 31-year-old resident shot the intruder early Thursday, then told a woman inside the home to hide the firearm he had just used, police said.

I wonder if he'll use the 2nd amendment to appeal if he's convicted of probation violation. Even people on probation deserve 2nd Amendment rights, do they?

Federal Firearms Act of 1938 (repealed and superseded by the Gun Control Act), good luck with that. Take it up with Alan Gura. If anyone can win it, he can.

If its a non violent crime , a good lawyer could probably fifht for jury nullification. I also wonder what warrants the burgler had. That will also affect the case.

I have a friend who was involved in an abusive marriage...she called 911 and they dispatched a deputy.

She always jokes (now 17 years later) she's still waiting on them to arrive.

he has to face the consequences. People who have a conviction which circumscribes their 2nd Amendment right should petition for restoration of those rights, or relegate themselves to the use of other arms, as allowed by law.
