10 charged with illegally selling firearms at Dothan flea market; 200 guns seized

DOTHAN, Alabama -- Ten people were arrested for illegal gun sales that took place at Sadie's Flea Market in Dothan.

U.S. Attorney George L. Beck Jr. for the Middle District of Alabama and Special Agent in Charge Jeff Fulton of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), made the announcement today on the steps of the federal courthouse in Dothan.

Those arrested had rented booths at Sadie's Flea Market and engaged in the sale of firearms, the U.S. Attorney's Office stated. ATF agents seized over 200 firearms and over 5000 rounds of live ammunition.

Nine of the 10 arrested are accused of selling guns to individuals they knew had been convicted of a felony. Four were also charged with selling firearms without a license.

4. Whoa, wait

So it is illegal to sell guns to prohibited persons at shows?

And there are enforceable laws to arrest people who do this?

But haven't we repeatedly heard anyone can walk into a show and buy a gin no questions asked?

Could one say that then there really is no "gun show loophole"?

You are not claiming there is any ATF regulations, federal (or state) law that specifically applies a different, stricter standard of sale of firearms sold at flea markets compared to gun shows...

20. No! Just clarifying.

All the hoopla eems to be about gun shows and their supposed loopholes. But apparently, these clowns just set up shop at a flea market. Something I've never seen, but I live a sheltered life. I see no reason why the ATF or federal law would be any different.

A couple sellers I know of was a retired ATF and another was retired NYPD. An occasional or one time sale by an unlicensed person is legal. When the guy shows up every day the market is open makes look like an unlicensed dealer. I have often wondered why the ATF doesn't bust a lot of them.

it's a lot easier to complain about not having the funding to do you job than to actually execute? I know of several circumstances where local LEO's have been temporarily deputized as U.S. Marshals for warrant sweeps. Seems you could do something similar for checking flea markets and gun shows if one wanted to seek to enforce federal firearms laws. YMMV

Good to see some enforcement, but if the consequences are no more than a slap on the wrist, then the laws are not effective. As this is a federal case they may well get some serious time.

14. any violation of the Gun Control Act

including clerical errors by licensed dealers can get up to ten years (which is why the guns/cars analogy is absurd). Of course, few people actually get that, and ten years is over the top and should be reserved for violent felonies. Felon in possession is a mandatory minimum of five. The guy that sold the Son of Sam killer the revolver got five years for interstate sale without an FFL (the killer was a NY resident. The seller was a TX resident)
