Chicago Ban on Gun Sales in City Unconstitutional, Judge Rules

Chicago’s ban on gun sales within the city is unconstitutional, a federal judge ruled, saying the local law on weapons “goes too far.”

The judge delayed the effect of the ruling to give the city time to respond.


It'll be entertaining to see what argument Chicago uses to try to justify this to the Court.

it has a "defacto" effect of banning use of such items by making them extremely hard to get.

are subterfuge designed to restrict/deny a particular right. You might get away with a "county line" restriction with alcohol sales, but not with a constitutional right. See the first sentence of the 14th (1866).

Where they tried to put a high tax on printers ink?

IIRC, SCOTUS said it was a clear attempt to restrict first amendment rights and was flat out unconstitutional.

Surprise, the second amendment is as valid as the first and apparently subject to the same level of legal scrutiny.

Following McDonald with incorporation I expect to see a series of these kind of rulings and Bloomberg's blood pressure rising well beyond what his usual compulsive salt consumption causes.

It's a stupid law anyway. How is prohibiting legal gun stores in chicago preventing gun crime? All it does is make it harder for law-abiding people to purchase firearms.

I keep hearing this "need" to "compromise" on gun legislation but when I see this crap being passed into law I really wonder sometimes.

money on cases it knows it is going to lose. How much money has Chicago paid out to the NRA and the Second Amendment Foundation? How much more are they going to pay out?

That is what mainstream gun control is mostly about. I'm not saying there are those that aren't sincere about gun violence but that much of its support (especially on this site) comes from a general hatred with who/what is associated with gun ownership.

They will be appealing to the same courts that said a ban on CCW was unconstitutional.

But Rahm who can't seem to grasp the idea of a constitution that doesn't conform to his whims, will run up another big 7 or 8 figure legal bill, get his skinny ass handed to him again, then raise "fees" and put in more traffic cameras to pay the freight.

Next time you fly into Chicago don't be surprised at your landing fees going up, along with your tickets, taxi, dinner and hotel bills.

13. No surprise to me. What will be interesting is if the violent crime rate in Chicago falls ..

dramatically.

Since most of the violent crime in Chicago is a result of drug gangs fighting over turf, that probably will no happen.

Still I predict a number of incidents in which an honest citizen will be able to use his firearm to stop an attack from a violent criminal.

It will be interesting to watch but of course the main stream media will do their best to ignore such incidents.
