A 53 year-old homeless man was arrested after trying and failing to use a counterfeit $20 bill to buy toothpaste and food. @ManhattanDA prosecuted him, a jury convicted, and he was sentenced to 4-8 years in prison. Ct. of Appeals just reduced it to 3-6. http://www.nycourts.gov/reporter/3dseries/2019/2019_00371.htm … Link to tweet

5. That is not justice. It is an extreme waste of resources on a foundation of stupidity.

7. Is he the counterfeiter? If so that's a fairly serious crime ...
If he just unknowingly used a fake $20, this sentence is an absolute f***ing travesty.

9. How many homeless people have the ability to create at least passable counterfeit bank notes?
I'm guessing zero!

8. So that's $150,000-$300,000 in taxpayer money
which will be used to house him for the duration of his incarceration. This is not remotely sensible. It is not rational! It would make more sense to give him $30k per year for 10 years so he can get his own place and get the help and support he needs to be able to support himself.
There needs to be a de minimus rule in sentencing where there's no jail time if the amount of money involved in the underlying crime is less than (I'll throw out a number) $10,000. |

10. Just a guess, but it's completely possible that he was given the $20 bill
while panhandling. That would be some sick shit.

11. Ones and fives
If I counterfeited, I'd make ones and fives.
