At this stage of its growth it should have a real fragrant smell.

The waxy leaves make me think it is.

4. I think its magnolia, as suggested,

and its a BIG tree, and no fragrance. I love gardenia, and might buy a plant, just to have it around.

I like to plant gardenias close to a window to take advantage of the fragrance. Jasmine too.
