CHARLOTTESVILLE, Va. (AP) - A federal judge is set to hear arguments from white nationalists and others that a lawsuit against them over last summer's violence in Charlottesville should be dismissed.

A hearing on motions from a number of defendants to dismiss the lawsuit brought by 10 Virginia residents is scheduled for Thursday morning in federal court in Charlottesville.

The lawsuit was filed in October by plaintiffs who said they were injured as a result of white nationalist events last August.

On Aug. 11, white nationalists marched through the University of Virginia campus with torches, chanting racist slurs. The following day, attendees of a rally and counterprotesters clashed violently.

Ohio-based attorney James Kolenich and co-counsel Elmer Woodard, a local guy, have arrived at the federal courthouse ahead of a hearing in the case of Sines v. Kesser. They represent a slew of white nationalists in this case, including Kessler and “Crying Nazi” Chris Cantwell.

He is not doing very well in state courts.

When I saw this (I follow C-VILLE) I was amused by their projected personas. Southern gentlemen all the way.

Kessler and Cantwell have counsel at this hearing. In some they are representing themselves.

Federal judge to rule on motions to dismiss in August 12 victims’ case

In a lawsuit filed on behalf of 10 alleged victims of last summer’s deadly August weekend in which hundreds of white supremacists and neo-Nazis descended upon Charlottesville, a federal judge is now considering whether to grant several of the defendants’ motions to dismiss the case.

Attorneys Roberta Kaplan and Karen Dunn claim that 25 individuals and groups named as defendants in the suit premeditatively conspired to commit violence at the August 12 Unite the Right rally.

Plaintiffs include victims of the Fourth Street car attack, other white supremacist violence and extreme emotional distress, including Elizabeth Sines, Marcus Martin, Marissa Blair, the Reverend Seth Wispelwey and Tyler Magill, who suffered a stroke after being beaten on August 11.

Kolenich, who admitted during the hearing that he doesn’t know which Confederate general’s statue is causing such a ruckus in Charlottesville, said outside the courthouse that the judge should have a ruling within 30 days.
