Judge clears way for final vote count in Stafford Co.; disputed absentee ballots won’t count

WASHINGTON — After a temporary delay, a Stafford County judge cleared the way for a final tally of votes Tuesday afternoon in one of the tight Northern Virginia races that could decide control of Virginia’s House of Delegates.

The judge said two Stafford residents, who had sued over what they called confusing information about how to make sure their provisional ballots were counted, did not have standing to sue. The couple was represented by the NAACP Legal Defense Fund.

The lawsuit had asked the judge to delay final counting of votes until Friday. Virginia law requires local electoral boards to certify results to the state by 5 p.m. Tuesday.

But in a 2-1 vote Tuesday afternoon, the board decided to rejected the disputed absentee ballots.
