A defense attorney for Gov. Rick Perry said Friday he will file a motion in court to dismiss criminal charges against Perry, citing the governors veto authority and First Amendment rights.
The motion will speak for itself, attorney David Botsford said.
Senior District Judge Bert Richardson of San Antonio has set a one-week deadline for Botsford to submit his pleading and once he does so, Perry prosecutor Michael McCrum will be given time to respond.
Outside of a brief hearing in Travis County state district court Friday morning, McCrum told reporters, Im confident the law applies in this case. McCrum said he will not address evidence in his case and will approach it with dignity and respect.

(17,064 posts)File motion to dismiss. File motion for change of venue. When those denied, file motion for judge to recuse themself. File motions to suppress evidence. After a few months of this, they'll start getting ready for the actual trial.
