No charges against school officers who Tased Bastrop student

A grand jury has declined to issue any indictments following an incident in which a deputy sheriff used his Taser on a 17-year-old student, causing him to fall and leaving him with a brain injury.

Deputy Randy McMillan, who use the stun gun on Noe Niño De Rivera in the hallway of Cedar Creek High School last year, will face no state criminal charges, officials said Tuesday. Deputy Timothy Stalcup, who was at the scene, also will not face charges.

A spokeswoman for Sheriff Terry Pickering said grand jurors recommended no charges against Niño De Rivera, who is in a rehabilitation center in the Hill Country.

Forrest Sanderson, a special prosecutor who had been appointed to handle the case said Tuesday that his goal was to ensure grand jurors had a complete account of what happened that day.
