Court upholds ruling that tossed out tribe s land claim

Dismissal of a tribal land claim involving land in Oneida County has been upheld by the U.S. 2nd Circuit Court of Appeals in New York City.

The Stockbridge-Munsee Community of Wisconsin brought the appeal after a federal judge dismissed its claim last year to about 23,000 acres in Oneida and Madison counties.

“It is well-settled that claims by an Indian tribe alleging that it was unlawfully dispossessed of land early in America’s history are barred by the equitable principles of laches, acquiescence and impossibility,” states the unsigned June 20 decision.

​The decision also said, “The claims in this case are foreclosed by three decisions that resulted from decades-long litigation conducted by other Iroquois Nations: the Cayuga, Oneida and Onondaga.”
