Position Paper - Initiative and Referendum




Initiative, Referendum, and Recall were added to the Arizona state Constitution to bypass the government in Phoenix if the people decided the government in Phoenix were either moving too slow or passing bills that people didn't like.

Prop 208 is now under attacks by the Republicans in the House. Here is my position and, if elected, I will propose this bill within the first seven days of office.

Any voter passed laws through election is the law, whether the legislature agrees or not. I support a law where any vote not to enact, disable, or fail to fund a voter-passed initiative would, at minimum, trigger an instant recall election, or, at maximum, be seen as an instant resignation by the legislative member that votes that way. The law would also add a disqualification for holding elected office to represent any part of Arizona for life. This applies to the governor as well.


No act of legislation should be used to overturn a voter initiative. That is for the courts. If the law violates the State Constitution, get a judge to issue an temporary injunction, then go to court to have it overturned. It should be illegal to draft legislation to overturn voter approved laws.
