Mariah Carey sued for copyright over 'All I want for Christmas is You'

Singer Mariah Carey is being sued for copyright infringement over her 1994 Christmas mega-hit, All I Want for Christmas is You.

Songwriter Andy Stone says he co-wrote a song with the same name five years earlier, arguing that Ms Carey exploited his "popularity" and "style".

Despite sharing a title, the two songs appear musically different, but Mr Stone claims Ms Carey caused confusion and did not ask for permission.

It is not unusual for different songs to have the same name, and the United States Copyright Office lists 177 entries on its website under the title All I Want for Christmas is You.

Even if they were, waiting nearly three decades to sue over one of the most omnipresent Christmas songs out there is farcical. The lawsuit should be summarily dismissed, and the plaintiff and lawyers who filed this suit should be hit with penalties for being ridiculous.

You cannot copyright a song title. You cannot copyright an album title. I have a lengthy list of "Same title, different songs" that I'm going to use one of these days for a playlist (I DJ online). Just for the novelty of doing things like playing Boz Scaggs' "Lowdown", followed by Chicago's.

And oddly enough... Madonna has two songs called "Forbidden Love". Same title, different lyrics and melodies.

Anyway, the article I read has stated that Mariah's version does not have the same lyrics or melody as Andy Vance's or Vince Stone's (or whatever his name is). As a result? He has no case. None. Now, I doubt Mariah had ever heard of him or heard his song before (just as I hadn't heard of this guy until yesterday). But even if she did, and knew using the same song title would was the cruise control to cool? It doesn't matter. He would have a case if she stole his lyrics or melody, but, he has no case over a song title.

I fully expect the judge to quickly dismiss this - with prejudice - and hopefully issue a fine for a frivolous lawsuit and wasting the court's time.

See, people.. This is why some of us can't count on the legal system. It's drowning in a sea of bogus, time-wasting lawsuits like this joke.

Ohhh... And Vince? There is someone involved with this trying to exploit someone else's popularity. You may want to look in your mirror...
