I can see them preparing the indictment and telling him it will drop in Septermber 2024 if he doesn't withdraw by then.
I can also see them letting it drop even if he does drop out, but not until after the 2024 election.
No one wants to set a precedent of an incoming administration going after an outgoing one, no matter what. The silly grounds for impeaching Clinton was over the Nixon near impeachment. Nasty vindictive people hold grudges forever.

(124,254 posts)a better argument can be made that once the mob was at the rally TFG incited and inspired them to invade the Capitol and try to stop Congress' proceedings. I think it's probable that some groups like the Proud Boys actually had made plans to enter the building, since they were wearing military-type gear and carrying things like zip-ties (and, of course, there was the gallows for Mike Pence, which somebody must have made in advance). However, there might not have been a centrally-coordinated plan among those thousands of morons to all invade at once (and most of them didn't seem to know what to do or where they were going once they got in). If not, and if most of the morons had come to DC just to demonstrate and didn't decide to follow the smaller, more organized groups until after TFG made his speech, that's pretty good evidence that TFG really did incite the insurrection.

(124,254 posts)What I am saying is that some groups planned to do it (the existence of the gallows makes that apparent), but that there might not have been a centralized plan that everyone in the mob knew about beforehand and intended to carry out. Kirschner's point is that it would be much easier to prosecute TFG for inciting the insurrection if there hadn't been a single centralized plan beforehand and that it was his rally speech that motivated most of them to enter the Capitol with the intent to stop the proceedings. Otherwise he could argue that he had nothing to do with any of it (which is what he is, in fact, claiming) because it was all planned by the participants long before 1/6.

Slow-cooker in oil is the sweet spot. Once and done.

(3,764 posts)If the SOB does not get jail time for his crimes then USA Democracy will become a joke, bot only internationally but in the USA. Why should any citizen believe in USA Democracy when thugs like trump, his family, and the many republicans can be proven guilty but the DOJ lets them go...How is that different from a banana republic? How is it different form a Taliban regime? or a Kim Jun Un rule where he breaks the law anyway he wants but there is no one to make him accountable.
How is that different???
This is beyond tragic if the SOB doesn't get his time in an orange suit.
