For everyone worried about this contrived national emergency, Constitutional scholar Neal Katyal explains it well on this segment. Some points from his comments below referring to the Idiot's ill-conceived national emergency: - This is a Constitutional disgrace, antithetical to the Constitution... - Article 1 of constitution: "No money shall be drawn from the Treasury but in consequence of appropriations made by law." - The Founders' message is clear. Trump's legal advisors are giving him bad advice when they try to reprogram funds on grounds of a national emergency. The president not getting what he wants from Congress is not a national emergency. This will be challenged in court immediately, and is easy to throw out. - Re: the $2.5B from DoD drug interdiction program, this is not in the jurisdiction of DoD...Constitution lets Congress decide after appropriations. - Presidents do not have latitude to define emergency as a contravention to congress. ______________________________________________________ Love Neal Katyal ![]() ![]()

1. Neal Katyal said we should confirm Kavanaugh, who is going to rule FOR Trump here
Katyal is a sellout, who helped get Kavanaugh confirmed. I understand his business depends on staying on Republican justices’ good side.
But he’s no hero. He’s done more to HELP trump’s emergency declaration than almost anyone else, by writing in favor of Kavanaugh ad Gorsuch. |

4. hmm i don't agree with him all the time, and definitely not in regards to Kav & Gorsuch
but in many cases where i've heard him comment on trump's actions as it relates to the Constitution i do agree with him.

5. True. But pushing Gorsuch and Kavanaugh is FAR more consequential
We needed lawyers with integrity to stand up to the two stolen Republican SCOTUS seats. They may be on the court for decades (though we should work to impeach/pack the courts to undo the stolen seats).
The illegitimate justices have already made the difference in several illegitimate decisions, including the Muslim ban. So Katyal may make us feel good with his words now. But his support of Gorsuch and Kavanaugh, while good for Katyal’s business, harms the American worker and has harmed honest Muslims in America. |
