GOP Lawmaker Wants to Charge Rape Victims Who Have Abortions with ‘Evidence Tampering’

If a Republican legislator in New Mexico gets her way, women who have abortions after being raped could face jail time for "tampering with evidence."

State Rep. Cathrynn Brown (R-Carlsbad) introduced a bill yesterday that requires rape victims to see their pregnancies through during the course of their sexual assault trial, or be charged with third-degree felony evidence tampering.

From House Bill 206:

Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime.

Every father in the US could be charged with rape if the birth of a child is evidence of rape.

Another female female impersonator introduced this bill. No actual woman would do such a thing.

BTW, the statute of limitation on rape in New Mexico is never or 5 or 6 years, depending:

New Mexico Statutes of Limitations for Sexual Assault
Limitation: Prosecution may commence at any time after the occurrence of a capital felony or a first degree violent felony; (A) Second degree felony, within six years from the time the crime was committed; (B) Third or fourth degree felony, within five years from the time the crime was committed (N.M. Stat. Ann. § 30-9-11
