Trump charged with 37 counts in classified documents case, indictment says

A 37-count criminal indictment against Donald Trump was unsealed Friday, revealing allegations that the former president willfully retained hundreds of classified government records and conspired to prevent their return to U.S. officials. The charging document, which alleges Trump kept records containing national defense information at his Florida home after leaving the White House, was made public a day after a grand jury in U.S. District Court in Miami voted to indict him. Among other allegations, the indictment says that Trump showed classified documents to other people in the summer of 2021, after leaving office in January of that year. One of those documents was a “plan of attack” that he told a publisher and writer at his Bedminster, New Jersey, golf club was prepared by the Pentagon. “As president I could have declassified it,” Trump told them, according to an audio recording of that July 2021 comment which is quoted in the indictment. “Now I can’t, you know, but this is still a secret,” he added. A month or so later at Bedminster, Trump showed a representative of a political action committed “a classified map related to a military operation” and told the other man “he should not be showing it to the representative and that the representative should not get to close,” the indictment alleges. Also charged in the indictment was Trump’s valet, Walter Nauta, who faces several of the same charges as his boss, with whom he allegedly conspired to keep classified records and hide them from a federal grand jury. 47. The Penalty Sheet...
lists no mandatory minimum prison time for any of the indictments against Trump.
I would think that these charges are so serious, that wouldn't matter...that he would absolutely face some time if found guilty. ...but still, I'd feel a whole lot better if the law stated a base sentence. |

By definition, a felony is a crime punishable by no less than one year imprisonment. 37 felonies carry a sentence of 37 years. For Trump, that would be life in the slammer no matter what.

that some of those "others" who were shown classified documents have given info to Smith and Co. and some of the friendly foreign intelligence services may have been aware that "others" got a look and maybe what they said was shown to them. I doubt Smith would include those charges if he didn't have it nailed down from multiple witnesses etc.

and he may find that all of the good ones want nothing to do with this case because they know the main target in this case is out of control and has never been fully truthful with his own lawyers. There is no telling what info might pop up next to whack any of the other defendants and their lawyers. I won't be sad if "Cash" has to end up with somebody like Orly Taitz for a lawyer.

40. Am I reading it correctly that he might not serve prison time
At the end of the indictment, it mentions each charge and a mandatory minimum time as well as a maximum time for each as well as fines. All of the mandatory minimum listings are NA, while the maximum have the specific years attached. Does this mean he could possibly get no prison time, and just some massive fines since there is no mandatory minimum sentences described? I certainly hope not.

And if they DO give him massive fines, they better be VERY MASSIVE & the court better have a way to make him pay using HIS money & not donors. Assuming he's found guilty

I am a firm believer in voter accountability. If these serious charges becomes a media circus that would put Trump over and win the presidency, we then have a situation here where his voter must be compromised accordingly and with highest extremities.

I have a feeling that Walt Nauta was indicted with the same stroke of the pen so that he can be "convinced" to testify against Trump.
Nauta may be the most devout of Trump loyalists, but it's funny what facing life in Supermax will do to someone. So, I don't see a plea offer for the Orange Traitor. |

84. Though I was being somewhat tongue in cheek...
I've noted that the way it seems to work on regular people is they plead guilty to aggravated manslaughter and prosecutors drop the charges of trespassing and littering.
Police always overcharge with crimes they know would be hard to prove or mean little for the outcome. I just thought it humorous if Trump were to plea down to "only" a couple dozen charges of treason, espionage, and crimes against humanity. Like telling Jeffery Dahmer you'll drop the charge of operating a kitchen without a food permit. |
