Grand jury in Trump classified documents case expected to meet this coming week after hiatusThis discussion thread was locked as off-topic by JudyM (a host of the Latest Breaking News forum). The federal grand jury that has been hearing evidence in the Justice Department’s investigation of former President Donald Trump’s handling of classified documents is expected to meet again this coming week in Washington, according to multiple people familiar with the investigation. Prosecutors working for Special Counsel Jack Smith have been presenting the grand jury with evidence and witness testimony for months, but activity appeared to have slowed in recent weeks based on observations at the courthouse and sources. It’s unclear whether prosecutors are prepared to seek an indictment at this point. The Justice Department would not comment on the status of the investigation. 11. In the time
between the grand jury meeting, it seems rather likely that Mr. Smith's team compiled a rough draft, evaluated what had at least a 95% likelihood of conviction, and fine-tuned it. It's to the point where there will continue to be investigating going on, but the DOJ is in a strong position, and the defendent in a weak one. More, Smith's team is growing stronger at the same rate the defendent's team is melting under pressure.

16. How often does a Grand Jury refuse to go along with recommendations of the prosecutors?
Has Jack Smith's team finally persuaded them to indict?
There is a time for everything under heaven. |

6. So they are either voting on indicments
or else considering yet more crimes that were just uncovered. With Trump its hard to keep up.

8. Ready with champagne for the grand jury's decisions.
As the model prosecution memo by Weissman, Vance explains,
"Indeed, the DOJ is likely now, or shortly will be, internally circulating a pros memo of its own saying so. That DOJ memo will, however, be highly confidential, in part because it will contain information derived through the grand jury and attorney work product...given the gravity of the issues here, our memo provides a sense of how prosecutors will assemble and evaluate the considerations that they must assess before making a prosecution decision...." ![]() |

9. Some states have a November deadline to get on the primary ballot
But realistically, it needs to happen before September 5 to avoid being less than 6 months before the first primary. After that it's happening "during primary season."
This better be the indictment. |

14. The only period DoJ is noting is the 60 days before the general election Nov 2024
There is no "six months" deadline, nor is there a prohibition against DoJ charging and other activities in any period other than that 60 days. That I'm aware of. If you have a credible link, now would be a good time to post it. |

15. Very interesting.
Is the Grand Jury prepared to act? Are the prosecutors ready to seek an indictment?
Something appears to be in the works. |

18. Speculation, speculation, speculation
It would be good to keep in mind that this sort of case takes a lot longer than anyone wants, it needs to be air tight (IIRC, if convicted of violating the Espionage Act, he can't be president - much is at stake here), and there can always be superseding indictments.
I am guessing (I am not a lawyer) that Jack Smith wants to ensure a very high probability for a conviction so he won't issue an indictment until he reaches that threshold, whatever that is. It's possible that the GJ will hear evidence of further crimes that we are not yet aware of, and that will make the case even more air tight. Or it's possible that they are ready to indict. We just don't know and all we can do is speculate, and all the "legal experts" are doing is the same speculation that we are doing, albeit with more legal experience. One thing's for sure: this DOJ runs a very tight ship and they don't leak. The recent "leaks"? I believe they are purposeful, and designed to get public sentiment behind upcoming indictments. It's also possible that public leaks are to get witnesses to cooperate and make deals, but that might mean they aren't all that close to indictments, because they'd need to "turn" such people and then present that evidence to the GJ. Maybe that's what they are doing now. |
