WASHINGTON — A federal judge sentenced a retired Air Force lieutenant colonel to two years in prison Friday for joining a mob that occupied the U.S. Senate on Jan. 6, 2021.

Prosecutors asked Bates to sentence Brock to five years in prison – at the lower end of the recommended guideline range they’d calculated – in no small part because of what they described as a “manifesto” he sent to another military veteran on Christmas Eve 2020. Titled “Plan of Action if Congress fails to act on 6 January,” the document laid out eight points that Brock described as “main tasks,” including:

- Seizing all democratic politicians and Biden key staff and select republicans, including Senators John Thune and Mitch McConnell, and interrogating them using “measures we used on Al Queda” (sic).

- Seizing national media figures. Brock wrote they should “eliminate them. Media silence except for White House communications.”

- Former President Donald Trump issuing a general pardon “for all crimes up to and including murder” for those who put down “the Democratic Insurrection.”

Brock’s task list also included the note, “Do not kill LEO unless necessary. Gas would assist in this if we can get it.”

Btw, Why wouldn't a conviction in a civil court count against him?

If he were tried in Military Court for the same crime he was convicted for in Civil Court, that would be double jeopardy, no?

38. It should, but there is that, double jeop; however,

a retired commissioned officer can be reactivated based on charges for certain crimes. Sedition is one. I wouldn't bet the farm that will happen, but it could give him something more to sweat while he's enjoying the ambiance of our prison system.

Back in boot camp they explained to us that if we were convicted of drunk driving (for instance) in a civilian court, we could then be convicted of drunk driving in a military court. Double jeopardy would not apply, because they are two separate laws. You can't be convicted of breaking the same law twice, but you can be convicted for your actions twice...

Or maybe they were just lying to us... Who knows. ::

Let us remember how awful prison is. Total humiliation being checked in, body cavity search. No privacy at all for 2 years; no snacks; no sex (masturbation is forbidden--really); the first year is probably the worst, getting settled in to the new regimen.

And forever listing this conviction and hiatus on your resume and life story.

He wanted to use his military training against fellow citizens. He broke his oath to uphold the Constitution and protect it against aggressors, foreign and domestic. Two years is just long enough to give him all the time he needs to refine his plans while giving him hope he’ll be out with time enough left in his miserable life to carry them out.

Edited to add: if he’s allowed to keep his military pension he won’t need to find a job. If he loses it, he could still have set up some kickass retirement account. And even if he’s got zip for retirement, there will always be some jingoistic MAGAt to give him work under the table. Or he can become an expert on Fox!

50. yes! I got 18 months for filing too many and too frequent

bankruptcies due to huge non insured medical bills I had cancer back before you couldn't kick some off of insurance, ran up a $192,000 medical bill. For the poor you either do time or send in money I had no money, spent 13 months in a federal prison and had my debt reduced by agreement to $10,001.00

I'm not happy about this. Kids have gotten 5 or more years for weed albeit over a certain number of plants or pounds, but this guy went in with one or more weapons. I'm counting zip-tie handcuffs as those are clearly for a single purpose.

ARTICLE 88. Contempt toward Officials

Any commissioned officer who uses contemptuous words against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct.

He can be activated to stand Courts Martial under Article 2, Section 4, as a regular service member in retired pay status.


It’s not double jeopardy because he wasn’t charged with contemptuous words by the DoJ. That’s a different crime. I think the very existence of the list of people to wanted to injure - naming dem politicians- is enough to convict him on UCMJ article 88.
