Judge blocks Indiana abortion ban on religious freedom grounds

Source: Reuters

(Reuters) - A second Indiana judge on Friday blocked the state from enforcing its law banning most abortions after Jewish, Muslim and other non-Christian women challenged it in a lawsuit.

Marion County Superior Court Judge Heather Welch issued a preliminary injunction against the Republican-backed law, which prohibits abortions with limited exceptions for rape, incest, lethal fetal abnormalities or a serious health risk to the mother. The plaintiffs have argued that the measure infringes on religious freedom protected by another state law.

The law had already been on hold, as another judge in September blocked Indiana from enforcing it while Planned Parenthood and other healthcare providers challenge it in court.

Indiana became the first state to pass a new law banning abortion after the U.S. Supreme Court in June overturned its landmark 1973 Roe v. Wade ruling that had legalized the procedure nationwide. Other Republican-led states quickly began enforcing older bans.

1. Right wingers should love this, right?

Cause they’re all for freedom of religion!

2. Run it by the Supreme court

Sammy the rat Alito, slappy Thomas and trumps three stooges will rule that religious freedom only applies to what Christian’s say it does. In the land of the free.

I’m still waiting for Catholics to fess up the bucks to support all babies born by women forced to give birth against their will until at least the child reaches the age of 20. There’s your religious freedom. But take a look around. Catholics have different things to spend their millions on. And why in the hell are Catholics always having fundraisers?

3. If it comes to that, this really will test if they mean ALL religion or just theirs.

Regarding Catholics always having fundraisers...not every Diocese has the luxury of shipping all funds out and then declaring bankruptcy when it turns out they've been protecting child molesting priests.

4. Oh NullTuples, I believe we are kindred spirits

I was born, raised, groomed Catholic. Broke the chains. Live in Kansas. Catholics spent a large amount of tax exempt money trying to codify their hate relative to abortion. Lost. Local Catholics spent 600+k building a mansion for one man. Their local shaman. He’s hustling with the fundraisers. I guess the papists overspent this year.

A little lagniappe (Cajun for a little something extra) catholic hierarchy in Kansas are opposed to expansion of Medicaid in the state.

Protecting child molesters. A proud papist tradition.

Gosh, I wonder what Jesus would do.

14. The political turn about is also fun to watch.

Republicans for years had a great wedge issue with abortion. Then they got their way. Except they gave there great wedge issue to us!
We will be able to use the abortion issue for years.

8. "Non-Christian women"

Why can't Christian women join them in their lawsuit?

Samuel Alito does not speak for me. And from what I recall, the Catholic Church did not oppose abortion up to the quickening.

12. The point, as I see it, is that the country is under assault by people who assert that...

… America is a “Christian nation” and that others need not apply for full citizenship. That it is a “White nation” and others need not apply. Those people also (in their own opinion) get to decide which flavor of Christianity is the “real” one — which is one of the many terrors of theocracy.

If enough Christians do all they can to restore their good name by speaking out, it will go a long way toward righting this ship. It’s one reason I don’t scorn those who preface their personal abortion sagas with, “I am a Christian,” because other Christians need to see and hear. That’s only one facet of speaking out. Another facet is to assert that the very words of Jesus call Christians to radical compassion, and health care for women certainly is that.

Meanwhile, lawsuits like these give me tremendous hope.

Democracy and rule of law aren't reliable in imposing one's fucked up world view on everyone else.

11. Yes! A judge finally gets it

The First Amendment protects us against tyranny by a bunch of religious zealots in a religion we don't share.

Religious dogma has no place in civil law. They can thunder whatever they like from the pulpit, but that's where it belongs.

13. Freedom means it is up to me.

Jews do not believe life starts until the first breath.
Many Americans have no religious conviction.
Yo Christians you cannot force your religion on me.
In the Islamic tradition, 120 days after conception, at which time, according to the Hadith, the process of “ensoulment” occurs; that is, the time in which the soul (rū? enters the fetus post-conception.
They are welcome to that faith.
Some Hindu theologians believe person hood begins at 3 months and develops through to 5 months of gestation.
As long as they do not mess with my freedom I don't care.
Either you believe in freedom of religion or you don't.
