Indicted Colorado clerk Tina Peters faces another arrest warrant for violating bond

Source: CNN

Updated 6:02 AM ET, Fri July 22, 2022

(CNN) A Colorado judge on Thursday issued an arrest warrant for Mesa County Clerk Tina Peters, a leading election denier who lost last month's Republican primary for secretary of state, after she allegedly violated the terms of her bond for a second time. Peters is accused of sending an email to the county director of elections in violation of a court order, according to an affidavit filed with the Mesa County District Court.

The arrest warrant is the second in as many weeks for Peters, a proponent of former President Donald Trump's election fraud conspiracy theories, who has been free on bond after being indicted earlier this year on 10 counts related to voting machine tampering allegations. She has pleaded not guilty. Last week, Peters faced an arrest warrant for violating her bond by traveling out of the state without the court's permission. That warrant, however, was thrown out last Friday after Peters' attorney, Harvey Steinberg, said he wasn't aware of the court's imposed restrictions on Peters' out-of-state travel until she had already left the state for Las Vegas.

In the affidavit for Thursday's warrant, Mesa County Director of Elections Brandi Bantz informed police that she had received an email from Peters regarding a recount she was requesting in her unsuccessful run for secretary of state in the Republican primary. The email also went to election officials in dozens of other counties, according to a copy provided to CNN. The affidavit says Peters appears to be in violation of a protective order that she have "no contact with employees from the Clerk and Records Office" in Mesa County.

Peters did not immediately return a request for comment from CNN Thursday evening. Steinberg, her attorney, told CNN he would not comment until he had a chance to see the warrant. Peters was indicted by a grand jury after prosecutors said she and her deputies allegedly facilitated a security breach in May 2021. The breach resulted in confidential voting machine logins, and forensic images of their hard drives, being published in a QAnon-affiliated Telegram channel in early August 2021. She pleaded not guilty and was not allowed to travel out of state without permission from the court.

9. ina Peters turns herself in after arrest warrant issued for bond violation

Tina Peters turned herself in to authorities on Thursday night in Pitkin County following an arrest warrant issued by the Fruita Police Department. Online records show that she turned herself in at 9:22 p.m. Thursday at the Pitkin County Sheriff's Office. She was released about an hour and 15 minutes later.

The Fruita Police Department issued an arrest warrant for the embattled Mesa County Clerk on July 21. According to a police affidavit, Peters violated the current conditions of her bond by contacting at least one employee at the Mesa County Clerk and Recorders Office.

The affidavit states Peters sent an email to eight state employees at around 2:45 a.m. on July 20. Per her bond, she is forbidden to communicate with employees at that office, and she is the subject of a restraining order prohibiting that communication.

A recipient of that email called the police. The email addressed hand recounts of the recent June primary election in different counties. Peters allegedly told the employees, "if you are on the list of those counties for a hand recount, you will be notified to coordinate the day/time that is mutually agreed upon. Thank you for your kind cooperation."

11. She can wait for her trial in jail.

Now that she’s proven herself untrustworthy. Jail seems like a pretty good option.

ASPEN, Colo. (AP) — A rural Colorado official known as the state’s most prominent election denier surrendered to authorities amid allegations she violated the terms of her release as she awaits trial on accusations of breaking into her county’s election system.

Mesa County Clerk Tina Peters turned herself at the Pitkin County Jail in Aspen in Thursday night and was booked, said Parker Lathrop, the county’s chief deputy of operations.

She was released on bond later that night, Lathrop said. Authorities claim she had violated bail conditions by contacting workers at the Mesa County elections office.
