Texas AG Ken Paxton says he's "willing and able" bring back state ban on gay sex

"They won't stop till they roll back all of our civil rights," Paxton's Democratic challenger said

Civil libertarians have been warning that if Roe v. Wade was overturned by the U.S. Supreme Court, other civil liberties would be in danger as well. And sure enough, when the High Court announced, on Friday, June 24, that it was overturning Roe, Justice Clarence Thomas recommended that the Court "reconsider" some landmark right-to-privacy decisions on contraception and gay rights.
One of the cases that Thomas specially mentioned was Lawrence v. Texas, a 2003 ruling that struck down a sodomy law in the Lone Star State and, by extension, similar laws in other states. Now, far-right Texas Attorney General Ken Paxton is indicating that he is open to the possibility of criminalizing gay sex in Texas once again if Lawrence is ever overturned by the U.S. Supreme Court.
Sydney, Australia's 9News reports that when Paxton, during an interview, was asked if he would be willing to take a challenge to Lawrence v. Texas to the U.S. Supreme Court, he indicated that he would. And Paxton also indicated that he would enforce Texas' old sodomy law if Lawrence were overturned.......................
...............
When the U.S. Supreme Court handed down its 6-3 Lawrence ruling in 2003, Thomas was among the three dissenters; the other two were the late Justice Antonin Scalia and then-Chief Justice William Rehnquist. The majority opinion in Lawrence was written by Justice Anthony Kennedy, a right-wing libertarian and Ronald Reagan appointee who was a strong supporter of right-to-privacy decisions and Kennedy, in Lawrence, used the right-to-privacy framework that had been a part of not only Roe, but also, other U.S. Supreme Court decisions such as 1965's Griswold v. Connecticut (which established access to contraception as a constitutionally protected right for married couples), 1969's Stanley v. Georgia and 1972's Eisenstadt v. Baird (which expanded Griswold to unmarried couples)....................................

(13,869 posts)While the law was clearly intended to target - and only applied to - gay sex, technically a married heterosexual couple having oral or anal sex would be guilty under the sodomy laws of most states.

(17,911 posts)You'd think these people would have gotten a clue from all the fall out when the Puritans banned freaking Christmas. A Christian celebration, no less, that was much too fun and frivolous for super duper, special Christians like Oliver Cromwell and his merry band of god bothering assholes. Lucky for England the immense wanker soon died and the monarchy was restored. One of Charles II's first acts was to have Cromwell's body exhumed, hung at Tyburn gallows, decapitated and old Ollie's head displayed on a spike at Westminster. Payback for killing his dad no less, but generally for Cromwell being a gigantic dick. Maybe Texans can do the same to Paxton. Just don't wait until he croaks. It's much more fun when they're still wiggling.
Oh...did I mention I despise these people?

(17,911 posts)and none of this stuff supposedly affects people with money. Wonder how many thought that when Gilead was setting up shop?
I've often wondered how they reconcile the fact that since the 80's their party has been run by people who'd like nothing better than to literally burn the Log Cabin Republicans at the stake. That kind of soullessness is lost on me.

(63,203 posts)for saying that we are fast approaching the point of "by any means necessary."
Certain cheerleaders found it necessary to admonish me for advocating for murder (which I didn't do), while they also brush off any suggestion that we're in the middle of a real and worsening catastrophe.
And next year, when the extremist Christofascist SCOTUS rules that state legislatures have absolute authority in their states' elections, the republic will die forever, because we'll see permanent, unbreakable Republikkkan majorities at every level and in every branch of government.
Perhaps the cheerleaders could be so kind as to scold me again because my glasses aren't sufficiently rose-colored.

(199 posts)I grew up in western PA, son of a very progressive couple, politically active, in local and state politics. My family also rented housing in our college town. Initially they only rented to groups of girls, but eventually to boys as well (that didn't always go so well). This was for large houses for students. They also had some smaller places for families and couples. One rule they had in their leases was standard boilerplate that 'no laws could be violated on the premises'. This included sodomy laws (Oral sex is considered to be sodomy), so unfortunately unmarried couples could not rent from us. Roommates, however, regardless of gender, were allowed.....
Other landlords in our town used these laws to discriminate against prospective tenants, and our family received a lot of backlash for renting to single mothers, unwed couples, and interracial couples (technically legal, and rare, but this was a time when Italians were considered to be immigrants and lesser races).
I thought that was all behind us. 50 years later, I am seeing it all again.

(9,977 posts)Wed be a lot better off if a lot of them left. Since thats virtually impossible, perhaps we really do need to consider splitting the country. There are all kinds of enormous complications, including Democratic cities in red states, but we have entered uncharted territory toward total fascist rule and Id rather see the US separated than to see another bloody civil war. And bloody it would be. In 1861, people had muskets, rifles, and pistols firing few rounds. The assault weapons of today are far more deadly.
I see this Falls election as truly our last stand. We obviously need to hold the House majority and gain at least three new seats. I say three because I remember the polls from South Carolina that had Harrison up around 12 points over Graham and he lost. Warnock is up around 10 points, for now, over Walker, but we cannot trust Georgia. Ryan has a chance in Ohio over the idiot Vance, as does Fetterman in PA. Demmings is neck and neck with Little Marco, but Florida is an untrustworthy state in the hands of rabid Republican cheats.
Wheres our third one? Thats where Ill also donate. Can Ron Johnson be beaten in Wisconsin? I just talked with a friend in Iowa who said that Grassley is a cinch in spite of his age because Republicans have made no secret that he is merely running to win so he can retire and the governor can appoint his grandson.

(852 posts)criminal charges. Charges which certainly seem to be, not even, slow walking they're through the legal system. Nothing hinky there.
"The state case and the federal one involve Mr. Paxtons work in 2011 promoting and recruiting investors for a technology company, Servergy Inc. Federal officials accused Mr. Paxton of encouraging and pressuring investors to invest in Servergy while failing to disclose that he was being compensated by the company. The investors included several of Mr. Paxtons friends and a fellow lawmaker.
Court documents filed by the S.E.C. claim that Mr. Paxton raised $840,000 from the investors and received 100,000 shares of stock in return, but never disclosed his commissions. Mr. Paxton told investigators that he accepted the shares as a gift from the companys founder, but the S.E.C. claimed that the stock was actually a sales commission he failed to disclose."

(61,596 posts)The previous Texas law, that was struck down by a long-ago Supreme Court that was thought at the time to be fairly conservative, outlawed sex acts that are not at all unusual among straight people. Bill Clinton was a famous participant, for instance.
Of course the police in Texas didn't barge into straight people's homes in the middle of the night to arrest them for having oral sex. They only did that to gay people.
