12 Republican-led states sue President Biden over climate change order

WASHINGTON — Twelve Republican-led states Monday sued President Joe Biden over his first executive order aimed at climate change, alleging he lacked the constitutional authority to implement new rules about greenhouse gases. The federal lawsuit, led by Republican Attorney General Eric Schmitt of Missouri, argues Biden violated the separation of powers clause in the Constitution because Congress, not the president, has the power to regulate. On his first day in the White House, Biden signed Executive Order 13990, directing federal agencies to calculate the "social cost" of greenhouse gas pollution by estimating "monetized damages" to inform future federal regulations. This includes changes in net agricultural productivity, human health, property damage from increased flood risk and the value of ecosystem services. But the 12 states that are plaintiffs say assigning such values is a "quintessentially legislative action that falls within Congress’s exclusive authority." They also say the economic ramifications of the order will be disastrous. 3. Going nowhere and wasting their taxpayer's money.
Then again, a majority of voters in those states elected these nuts in the first place. Maybe they deserve their tax dollars being wasted.

5. thats a ridiculous lawsuit.
All that the EO does is direct agencies to make estimates for planning purposes. How can this possibly be exclusively a purview of congress ? Are they going to also sue to forbid people from thinking about issues ?

6. It seems to me that the collection of data "to inform future federal regulations" is not the same as
actually creating new regulations.
I would hope the court would recognize this, but who knows. ![]() |

7. I hope it's no big deal, executive branches do cost-benefit analyses all the time
as part of decision making. And these bozos think the LEGISLATURE will better estimate such values? Better than say, scientists, actuaries, accountants, public policy makers? I don't think so.

The XO legitimizes the concept that climate change is at least partially man-made, and that some action must be taken to combat it. It is that potential action the plutocracts fear, hence they're trying to head it off at the pass.

Assigning numerical values to climate variables is an exercise in SCIENCE, not ledger-lating. Although I suppose Repubs could try to assign any nifty, self-fulfilling numbers they like. That would be nonsensical. But I repeat myself.

Republican state attorneys general from Arkansas, Arizona, Indiana, Kansas, Montana, Nebraska, Ohio, Oklahoma, South Carolina, Tennessee and Utah joined the suit.
I knew Montana would be in on it. Everyone needs to keep an eye on the Montana crew, only Tester is a Dem and he is against the decision on the KXL. Tester believes the lie about jobs, the issue is that Montana based it's tax structure around the extractive industries and it shows. Especially now. |
