Gun rights advocates back bill that would ban Nebraska from enforcing any new federal gun laws

LINCOLN — Gun rights advocates expressed fears Wednesday that their rights were in jeopardy because of the election of President Joe Biden and a promised push in Washington to address gun violence.

"We're at a dangerous point of losing our constitutional rights," said Anthony Arnold of Ashland.

He was among two dozen people who testified, and 238 who submitted letters, in support of a bill that would prohibit the Nebraska State Patrol, local sheriffs or the Nebraska National Guard from enforcing any new federal restrictions on gun rights.

Most backers voiced worries about losing rights to hunt, participate in shooting sports or the ability to protect themselves. But the sponsor of the proposal said his main goal would be to block the confiscation of guns, ammunition or accessories in the event the president or Congress made such a move.

In the interest of consistency, let's remember that we here on DU think that local government should be able to refuse to enforce federal immigration law.

4. Help me with this. Has there ever been a bill introduced in Congress to round up guns?

The closest thing I can think of was President Trump saying let's go ahead and take their guns now and worry about due process later.

All this will do is encourage the gunnuts nationwide.

Here in Virginia, Democrats have won the Gov, Lt Gov and Atty General for the past two elections and in 2019, we took the General Assembly because the Republican Party has moved so far to the right they have cut themselves off from the majority of voters. One item that alienates voters is the Republican insistence on issuing and AR-15 and 400 rounds of ammo to every newborn in the state (yes, I exaggerate, but not much).

In 2020, when the Democratic-controlled General Assembly passed four mild gun safety laws, the gunnuts went batshit crazy, descending on county Boards of Supervisors' meetings, demanding that each county declare itself to be a "Second Amendment Sanctuary," where no laws that violate the Sacred Second Amendment will be enforced. And EVERY COUNTY except for a few very Democratic counties approved such useless resolutions.

I can see it now -- here they come again.

17. The laws will still be in place but local authorities won't enforce them

Basically they are taking the same position on federal gun laws we do on federal immigration laws.

8. So Nebraska can just ignore Federal Marshals?

I know people who have tried that, and you'd think they'd just go away, but many are surprised when they get hauled off in cuffs.

This is a state that will ignore federal law, and I know it's been done with marijuana, but things like silencer or rapid fire crank bans get a bit more attention from the feds. Can Nebraska say they no longer abide by federal banking laws?

9. States aren't required to help the federal goverment enforce federal laws.

The federal government can send their own officers to enforce their laws. Those officers can't be ignored or actively impeded, but states don't have to lift a finger to help. Prigg v. Pennsylvania.

This is no different than cities not assisting ICE in deporting people.

And I thought that states can always enact more restricting laws, not the other way around.

Otherwise, the states with Weed legalization laws wouldn’t still be looking over their shoulder regarding the stricter Federal laws making it a class one substance.

Or am I missing something?
