As Soon as Trump Leaves Office, He Faces Greater Risk of ProsecutionThis discussion thread was locked as off-topic by Omaha Steve (a host of the Latest Breaking News forum). The president is more vulnerable than ever to an investigation into his business practices and taxes. President Trump lost more than an election last week. When he leaves the White House in January, he will also lose the constitutional protection from prosecution afforded to a sitting president. After Jan. 20, Mr. Trump, who has refused to concede and is fighting to hold onto his office, will be more vulnerable than ever to a pending grand jury investigation by the Manhattan district attorney into the president’s family business and its practices, as well as his taxes. *snip* Ms. James, in response to criticism from Mr. Trump last year, tweeted that her office “will follow the facts of any case, wherever they lead.” She added: “Make no mistake: No one is above the law, not even the President.” Read more: https://www.nytimes.com/2020/11/13/nyregion/trump-taxes.html Well, la dee dah ![]()

8. He will leave the White House (before the inauguration, at a time unknown) and go directly
to his private waiting plane, at the airport.
It will be done on the sly, so we will only find out after he and his spawn have landed, probably in Saudi Arabia. Yes, I know SA congratulated Biden, but they owe the turd, since he defended the dismembering murdering prince, MBS. I know I keep beating the dead horse (my apologies to all things equine), but we MUST make sure his plane tires stay FLAT. And I continue to opine that the ONLY show of generosity from the American people should be a gratis can of gold spray paint, for the "throne" in the corner of the cell. |

10. The Presidential pardon power. Its still seems muddled
Can he pardon himself from any charges he was up against, but was shelved because of his position, as Barr made it. Like the obstruction of justice charges, when he refused to allow WH witnesses to honor subpoenas for the Mueller investigation?
What about any future cases he sees coming up the pike? Like the rape charge? Can he pardon from crimes not even litigated yet? Can he actually pardon himself for any future crimes he may commit? Into perpetuity? |

14. No. The Con can't pardon himself
"Self-pardons
The legal and constitutional ability of a president to pardon himself (self-pardon) is an unresolved issue. During the Watergate scandal, President Nixon's lawyer suggested that a self-pardon would be legal, while the Department of Justice issued a memorandum opinion on August 5, 1974, stating that a president cannot pardon himself." https://en.wikipedia.org/wiki/Federal_pardons_in_the_United_States#:~:text=Self%2Dpardons,-The%20legal%20and&text=During%20the%20Watergate%20scandal%2C%20President,a%20president%20cannot%20pardon%20himself. It's wikipedia but gives citings. So since he can't pardon himself, likewise he won't be able to pardon himself for future crimes. |

16. Do you know if he would be legally allowed to run for office again?
Is that one of those norms that was never written down and should the Dem Congress consider passing a new law stating so (if we win the Senate)?
