NY AG serves notice to Trump on MSNBC she's coming after him and his family after the election
Source: Raw Story
Appearing on MSNBC on Saturday morning with host Ali Velshi, New York Attorney General Letitia James said her office is proceeding with investigations into Donald Trump and his family whether he wins re-election or not. According to James, her first concern is making sure there is no election interference in New York on Tuesday, before assuring the MSNBC host that the Justice Department can’t interfere with her when it comes to the Trump Organization and financial improprieties. “In New York, as you know, we have an investigation against the Trump Organization related to financial impropriety and that investigation is ongoing,” she began. “We will continue that investigation and at this point in time there’s nothing more that I can say other than the fact this they have used every legal attempt to block and deny us information and to witnesses. We filed requests to compel and we were successful. We had the opportunity to question Eric Trump and we are continuing to review all of the documents they have submitted and other witnesses as well — we look forward to questioning them also.” “To be clear, without telling me any details about the investigation, you are not subject to any other types of rules?” the MSNBC host pressed. “There is no immunity that someone can present the president with that limits your ability to pursue these investigations and put whatever charges forward you see fit. As the attorney general of New York, you’re not governed by the Department of Justice or any federal rules?” Read more: https://www.rawstory.com/2020/10/ny-ag-serves-notice-to-trump-on-msnbc-shes-coming-after-him-and-his-family-after-the-election/ Link to tweet

I guess I remember that being clear before. Seems a Trump year ago.

In my most humble opinion, it would have been better to keep this under wraps until indictments are issued.

31. That there has been an ongoing investigation and that Trump has been trying to block it
from being able to continue has been well reported already though so it would be kind of pointless to try and keep it low key or under wraps.

5. Saying stuff like this publicly is not the smartest idea.
Despite it being what we all want to see happen. The Trumps will just say she's prosecuting them for political reasons, and they'll play recordings of her and others saying this type of stuff ad nauseam.
She can say she's already won the Trump immunity argument, but fighting to get and serve a subpoena is different than trying to prosecute a criminal case. Trump himself is also insulated by an army of accountants, tax and real estate lawyers. The Trump Org is a major corporation, and has a finance department staffed in the hundreds. Trump just can't call up Deutsch Bank and say a property is worth X, he and his company are going to have to prove properties value before any loans. And it would be extraordinarily suspicious to the bank if Trump himself is delivering those documents to DB. He would have to involve his staff, and they would take the lead on delivering requested documentation. Those types of valuations take months to process. Trump is a big picture guy, the minutiae of those types of things are not something he'd work on. James appears to base a lot of their case on Michael Cohen's testimony. I have no doubt that if Trump really didn't want Cohen talking, there are ways they could have shut him up. |

29. This isn't telegraphing anything....
Donnie and the spawn have known for quite some time that state of NY is hot on their asses. The problems to date have been access to evidence, specifically financial records. Can't charge without evidence of crimes. And "I just know he's been up to no good" is not evidence.

10. The NY AG does civil cases only. Criminal prosecutions are handled by DAs. So at best we'll
see fines, asset seizures, dissolution of organizations, settlements of the sort we saw with Trump Foundation. At least from her office. They will, of course, share evidence of crimes with the appropriate DA, like Cyrus Vance.

16. In an absolute sense, yes they can prosecute some things, but from their own website FAQ:
"In general, the law states that this Office does not have jurisdiction over most criminal matters. The Attorney General prosecutes fraud in the sale of securities, anti-trust violations, the unlicensed practice of a profession, and other types of fraud, when the case is referred to the Attorney General by the head of a State agency."
So I cannot say for certain whether or not any Trump crimes will count as "fraud, when the case is referred to the Attorney General by the head of a State agency" but maybe it will. I doubt the first 3 items in the list will apply. |

18. In NY the Governor can direct the AG to investigate and prosecute...
Her office powers are very broad and flexible. NY state law allows the Governor to empower and direct criminal prosecutions to the AG. Also, any powers she does not have can easily be granted through the NY State legislature and sent to the Governor. Powers and laws of NY state can be changed as needed to allow her sufficient powers.
https://ag.ny.gov/bureaus "While the Attorney General acts independently of the Governor, the Governor or a state agency may request the Attorney General to undertake specific criminal investigations and prosecutions." Trump family crimes are right up the alley of the NY AG. She can indeed investigate and direct prosecution for crimes related to taxes, fraud, and a whole host of other things. |

28. Cheat big or go to jail....
Extra incentive, but on the other hand, that just adds to the list of crimes if cheat big doesn't work. Slither off to a country lacking an extradition treaty is still an option. If it were me, plan A, but make sure plan B is sitting on the tarmac with the engine warmed up.

19. The more psychological pressure that the crime family is put
under the better, and the more the public is reminded of their criminality the better we will be served, especially at this time. Their persecution claim will be inevitable, even if the AG said zero.

21. This is great. James, and other Attorneys General need to GRIND on the Trump
family. God knows, there are plenty of potential charges out there, ranging from a quarter million counts of reckless disregard for human life, 545 counts of genocide, over 10,000 counts of crimes against humanity, racketeering, treason, money laundering, etc.
I mean, Trump doesn't need to even try in order to be a corrupt piece of shit. With him it is effortless! |
