Giuliani gives alleged Hunter Biden laptop to New Castle County police

Rudy Giuliani’s efforts to tarnish Joe Biden’s presidential campaign continued in Delaware when he visited a New Castle County police station Monday to share files from what he said was Hunter Biden’s laptop.

“They’ve got a hard drive, or a laptop, or something to that effect. They try to turn it over to New Castle County PD. New Castle County PD calls us,” said Mat Marshall, a spokesman for Delaware Attorney General Kathy Jennings.

Jennings’ office subsequently gave the device to the FBI because the federal agency reportedly had opened an investigation into the veracity of claims about the origin of the laptop and how its alleged contents were shared with Giuliani’s team, Marshall said.

"As we’ve seen in multiple reports (the FBI) is looking into whether these claims are credible," he said, "In light of their investigation, we’re referring it over to them now.”

Not sure how much of the story is true, but this was supposedly a data recovery job. It has happened many times in the past that the original drive is destroyed in the process... but the copy shows evidence of a crime.

Prosecutors can still use it.

to get as much information as they can save. If someone gives a hard drive that has been partially destroyed to someone else and that person gives it to someone else who gives it to the police nothing on that hard drive or any evidence later found by using anything on that hard drive would be allowed as evidence of a crime. It is called Fruit of the Poisonous Tree since they can not use anything off of the hard drive since there wasn't any chain of custody.

The confusion comes from the name "forensic" - which conjures up images of CSI shows.

But that isn't the case. The term refers to any bit-for-bit copy of a physical drive - rather than the file-by-file copy that would occur if you just moved things from one drive to another. They aren't that uncommon and are not limited to law enforcement tools.

One of the early stories said that the mac store created an image of the hard drive on their server and then put that image on several physical hard drives. That type of work could absolutely be used in court - particularly since the FBI reportedly has the original anyway.

As I said... any difference between the drive turned over this week and the one that the FBI has would be evidence against Rudy & Co.

Sounds like this is Delaware police passing it on to the FBI rather than take it as supposed evidence of a crime. So Rudy doesn’t get what he hoped for.

Rudy had better hope that the version the FBI had had for almost a year is identical to the latest one.
