SCOTUS Will Review Trump's attempt to exclude undocumented immigrants from calculations.. (Census)

Supreme Court will review Trump plan to exclude undocumented immigrants from calculations for congressional seats

The unprecedented proposal would have the effect of shifting both political power and federal funds away from urban states with large immigrant populations and toward rural and more Republican interests.

A three-judge panel in New York said that Trump's July 21 memorandum on the matter was "an unlawful exercise of the authority granted to" him by Congress. It blocked the Commerce Department and the Census Bureau from including information about the number of undocumented immigrants -- it is unclear how those numbers would be generated -- in their reports to the president after this year's census is completed.

The justices put the case on a fast-track, and said they will hold a hearing in the case Nov. 30. The administration says it must present the plan to Congress in January.

1. A Democratic Congress better start remedying a fix

SC fast-tracks have sailed through. Really ridiculous. Takes 3 years for a tax return ruling but every lame-brain proposal they push is granted.

it's almost as if they packed the Supreme Court! But that's ridiculous, only Democrats are accused of "court packing".

5. I can easily see them as excluding undocumented immigrants from the census.

they're going to argue it allows for over-representation.

Not sure how this one is going to go, but in the immortal words of Luke Skywalker "I've got a bad feeling about this..."

8. What does the US Constitution say about the census?

Here you go: "The U.S. Constitution mandates that a census be taken every 10 years to count all peopleóboth citizens and noncitizensóliving in the United States. [2 ]Responding to the census is mandatory because getting a complete and accurate count of the population is critically important. An accurate count of the population serves as the basis for fair political representation and plays a vital role in many areas of public life."

Now we will see how constitutional based our SCOTUS really is when they make their decision.

9. I wonder how all those alleged 'originalists' are going to rule?

Seems like the Constitution and the Fourteenth Amendment are pretty clear about there being a distinction between persons and citizens, but I'm sure the conservative mind will find itself quite limber enough to twist it's parsing of "original intent" in order to achieve the desired outcome.

At least this will offer a temperature reading on the Supreme Court for the hopefully Senate majority Democrats, so it can stiffen their spine in taking the nessicary actions to undo the right wing court tampering and restore the court to being more representative of the American people.
