Conservative Watchdog, Website Sue University of Delaware to Obtain All of Joe Bidens Senate Records

Judicial Watch and the Daily Caller News Foundation announced on Wednesday that they are suing the University of Delaware in order to obtain former Vice President Joe Bidens (D) Senate records as the 2020 election nears.
The press release on the development noted that Bidens senatorial archives, which have been at the University of Delaware since 2012, were referenced by Tara Reade, a former Biden staffer who has accused the then-senator of sexually assaulting her back in 1993. A lawyer who no longer represents Reade had led the charge for obtaining Bidens University of Delaware records as recently as May 11. But 11 days later, Douglas Wigdor dropped Reade as a client. Days before that happened, reports by PBS NewsHour and Politico raised questions about Reades credibility.
Not much new has been learned since then, but Judicial Watch and the Daily Caller News Foundation are hoping to change that.
At the end of April, Judicial Watch submitted a broad FOIA request at the University of Delaware for Bidens archives. Note the use of words any and all records:

(2,122 posts)If the U of D decides to take this to the Supreme Court. Or any court. Because any decision can then be applied to Trump. If the school does take it to court they can use the same arguments Trump used to stop release of his records, which is precedent. IF they deny precedent and rule to release, then that decision can be used to force Trump to release his records. So the court is now in a corner - they can't have it both ways, and whatever decision they come to will apply to both Biden and Trump.
I'm sure they thought they are so clever to pull this stunt, but this will be a big backfire. I can bet that right about now, the light bulb has gone off in some con's head and they are beginning to think this may not be such a good idea..

(26,033 posts)Rather, they're expecting the U. of Delaware to refuse to hand them over, and the courts to take forever to rule, so that there can be a steady drumbeat of "What horrible things is Joe Biden trying to hide?" from September on. As always in these kind of campaigns, the suggestion of what might be there is a greater weapon than what is actually there.

This is a fishing expedition. I would strongly suggest the U of Delaware drag its collective feet, after all, there is a panemic and they're shortstaffed.
Klayman is really desperate here, grasping at straws. Reade's complaint must have read like a joke, otherwise the GOP would have not only released it, they'd have been running TV spots and entire hours on Pox and OAN to make sure nobody forgets it.

(35,711 posts)They can't show a compelling interest on behalf of Americans, whereas a Delaware right wing groups could at least have the standing to argue a compelling interest, win, and then spread it around. But this way, it's not likely to work. I'm no lawyer, but that's my understanding of the law concerning standing and whose interests the entity represents.
The archives might also work like a trust. Trusts are pretty safe from public prying.
