Trump Family Asks Court to Stop Publication of Tell-All by President's Niece

President Trump’s family is seeking a temporary restraining order to try to block publication of a tell-all book by the president’s niece, Mary L. Trump.

Ms. Trump is the daughter of the president’s late brother, Fred Trump Jr., and her book, “Too Much and Never Enough: How My Family Created the World’s Most Dangerous Man,” is scheduled to be published by Simon & Schuster on July 28.

A person familiar with the matter said a request for a temporary restraining order was filed on Tuesday by Mr. Trump’s younger brother, Robert S. Trump, in Queens County Surrogate’s Court, where the estate of the president’s father, Fred Trump Sr., was settled.

The filing is against Ms. Trump and Simon & Schuster, and it seeks to stop publication on the grounds that Ms. Trump is violating a nondisclosure agreement related to the settlement of the estate.

I don't think thy can be used to preempt an action, can they?

And, all an NDA means is that you will get hit with a huge fine that may or not be found to be legit in civil court. It doesn't mean you can stop someone from saying something, only that the person doing so can be sued and the court asked that they pay them.

I have a feeling Mary Trump already has lots of folks telling her they will pay the multi-million-dollar penalty.

it might be the return of the settlement. But courts don't like NDAs and tend to construe them against the party that demanded them. Also, they are often limited in their duration.

These agreements are almost always construed against the person who drafted and demanded it, and they provide for an award of money damages if breached. A nondisclosure agreement is a contract, and the remedy for a breach of contract is damages - either consequential or liquidated (previously agreed-upon) damages - possibly giving back the money from the estate. There might be some exceptions where business trade secrets are involved; a business could write a clause into an NDA where the parties agree that the disclosure of trade secrets would cause irreparable harm and that an injunction would be an agreed-upon remedy if one party was threatening to disclose that kind of information. But where the deal is just the settlement of an estate among family members, there are not likely to be the kind of business trade secrets that need to be protected.

Furthermore, Trump, as president, is a representative of the government, and I'm sure that in seeking to suppress the contents in that book he's acting at least in part in that capacity because he wants to protect his presidency. If so, his petition constitutes a prior restraint in violation of the First Amendment. Prior restraints are almost never allowed - not even in the case of the Pentagon Papers or John Bolton's book. I don't think there are any national security secrets in Mary Trump's book.

such upstanding folks. Never been more humiliated to be an American. Kinda glad we can't travel for a while. When I start traveling again and someone asks 'where are you from'? I'll just say Canada. It's just easier.

Besides, if he cheats his way to 'winning' in November I'll be headed north of the border anyway. I live in West Michigan. Canada is about 2 hours away. Not much of a move or sacrifice and I can keep my current job. I have to say, wouldn't miss much about this country right now. IF I long for the beautiful beaches of Michigan it's a 2 hour car ride away...no biggie.

she mentions the estate at all. She certainly has enough information regarding the rest of Trump's life without revealing aspects of the settlement.
