Congress can seek eight years of Trump's tax records, appeals court rules

Source: Washington Post

Congress can seek eight years of President Trumpís tax records, according to a federal appeals court order Wednesday that moves the separation-of-powers conflict one step closer to the Supreme Court.

The U.S. Court of Appeals for the D.C. Circuit let stand an earlier ruling against the president that affirmed Congressís investigative authority on a day when the House was holding its first public impeachment inquiry hearing. Trumpís lawyers have said they are prepared to ask the Supreme Court to intervene in this case and in several other legal battles between the president and Congress.

The D.C. Circuit was responding Wednesday to Trumpís request to have a full panel of judges rehear a three-judge decision from October that rejected the presidentís request to block lawmakers from subpoenaing his longtime accounting firm. The order does not mean Trumpís taxes will be turned over to Congress immediately. The D.C. Circuit previously said it would put any ruling against the president on hold for seven days to give Trumpís attorneys time to ask the Supreme Court to step in.

Trumpís attorneys also are planning to ask the high court as soon as this week to block a similar subpoena for the presidentís tax records from the Manhattan district attorney, who is investigating hush-money payments in the lead-up to the 2016 election. The New York-based appeals court ruled against Trump this month and refused to block the subpoena to his accounting firm, Mazars USA.

Court Rejects Trumpís Appeal in Fight to Keep Financial Records From Congress

By Charlie Savage

Nov. 13, 2019, 7:23 p.m. ET

/snip

A three-judge appeals court panel in October rejected that sweeping argument and upheld Congressís authority to issue the subpoena by a 2-to-1 vote. But Mr. Trump petitioned the full court to erase that ruling and reconsider the case. The court on Wednesday rejected his request, 8 to 3.

The eight judges in the majority included seven appointed by Democratic presidents, Bill Clinton and Barack Obama. One, Judge Thomas Griffith, was appointed by President George W. Bush, a Republican.

The three judges who dissented were all appointed by Republican presidents: both of Mr. Trumpís appointees on the bench, Gregory Katsas and Neomi Rao, the latter of whom had been the dissenting vote in the earlier panel decision. The third was a judge appointed by President George Bush, Karen L. Henderson.

Confirmed my previous post meaning 1 (R) judge voted along with the 7 (D)s.

7. Ship a hundred cases of beer to Brett Kavanaugh

If he's sufficiently sloshed when this gets to SCOTUS, he might forget Trump's instructions and actually uphold the Constitution.

9. The media have brought that up many times and his excuse was always "they were still being audited".

So it's been that stupid game of cat and mouse that has wound up in multiple courts with both Congress and NY state attempting to get them.

12. An 8-3 ruling

Would tend to indicate he has little chance to prevail at SCOTUS.
