Estheticians don't have to wax male genitalia against their will, B.C. tribunal rules

Transgender woman loses complaint against estheticians who refused her service

The B.C. Human Rights Tribunal has ruled against a transgender woman who brought 15 discrimination complaints after she was refused wax services at more than a dozen beauty salons.

Jessica Yaniv, who identifies as female but has male genitalia, contacted the businesses through Facebook messages requesting appointments, including for a Brazilian wax which is a service to remove most or all female pubic hair.

But according to Tuesday's decision, "... human rights legislation does not require a service provider to wax a type of genitals they are not trained for and have not consented to wax."

From what I read when this first came up, there were estheticians in the area that had no problem doing this but Jessica Yaniv chose to pursue those who would not and then take a human rights tribunal case against them. These tribunals can and have levied stiff fines in the past, awarding the complainants tens of thousands of dollars. In this case, Yaniv now has to pay $6k.

1. The tribunal made the right decision. I am glad they saw that the women in this profession have

rights too.

She loves how smooth it makes her feel, and no longer has to shave every day.

5. I'm almost 63 and buy bathing suits that look like sarongs...LOL

I still wear short shorts, but not that short and avoid wearing them to events where people are likely to look. Heck I kinda don't much care anymore...LOL

23. Lol!

Honestly, you know the best place to be is for people no longer caring? The nude beach. I go every year, and it's one of the most care-free places around. All ages, all bodies, and very few pervs.

22. No, they'd be directed to waxers trained for male genitalia. Female & male genitalia v different.

26. Like gluten-free v non gluten free wedding cakes are different

And may require to be directed to a different baker trained in gluten-free baking.

This falls into First World problem!

So I agree, people who wax genitals for a living can choose which type they wax! Never thought I would post that.

11. While I think "personal belief" exemptions like those the current US SCOTUS finds palatable

are utter BS... the OP's blurb indicates the tribunal found this to be an issue of training (and consent).

I am very, very, very much in favor of lack-of-competence/training/familiarity exemptions. People should not be doing things they are not competent to do because of otherwise-legitimate social and legal pressure not to discriminate against protected classes.

12. +1. Baking a cake is baking a cake no matter who you are doing in for.

So is filing a marriage license or filling a prescription.

Waxing male junk and waxing female junk is not the same job. You shouldn't be able to force people to offer a service they don't actually offer.

15. Glad the workers have choices in this matter

since waxing genitals is quite different from baking a cake, because of the genitals.

Ms Yaniv can probably find someone else if she wanted it badly enough. The tribunal made the right ruling.

16. The advertising for the estheticians' shop just writes itself, doesn't it?

"We gladly wax male genitalia." I'm sure the lines would stretch around the block for such a service.

19. Have you ever tried?

Nothing like handling hot wax whilst balancing in a position to see exactly where you are applying it.... then forcing yourself to rip it off in the correct direction at the right speed. Front to back and everything in between.

Iíll pass, lol.

20. Or BC like more than 2000 years ago.

The ancient Egyptians just called it "Unknown Territory Wax", since Brazil had not yet been created.

Or, yeah, British Columbia.

but there is no excuse for you to deliberately mis-gender her.

She identifies as female. Her name is Jessica.

28. Yaniv is a creep.

If I didn't know better I would assume this person was a right-wing plant meant to discredit trans people. She pretty much purposely hits every topic in the most outlandish way that it gives ammunition to the conservatives. Sadly she is legit person who at least on appearances seems to be who she claims to be, but just happens to be a really horrible person.

As far as I can tell, Yaniv doesn't have much support from the trans community either. She a troll who uses transgender identity as a weapon/tool to get attention and to be a legitimate pervert. I have no idea if Yaniv actually has gender dysphoria or if it's just a very elaborate troll/hoax, but I refer to yaniv as female out of respect for others trans people who may not know the entire story of this person rather than for yaniv.

I am glad the tribunals ruled the way they did. Maybe Yaniv will go away, but I doubt it because she loves the negative attention.
